Retro Sales - Ordering:

Before you can place an order, you will need to register and log in. Each person is allowed one customer account.

If you want to send gifts to different addresses from your own, please complete a separate order for each one.

Very occasionally, if the technology fails or we make a genuine mistake, your attempt to place an order may be unsuccessful. Whilst we cannot be held liable for this, we will do all we can to resolve issues arising from such events.

If your order is accepted, then you accept the obligation to pay the sum as made known to you at the end of the check out process together with the delivery costs as stated in these Terms and Conditions.

Availability

Our products are fresh and handmade. If on the rare occasion we are not able to supply something you have ordered, we will offer you an alternative, a credit with us or we will give you a refund, whichever has your preference.

Payment

We accept Visa, Mastercard, Switch, Solo, Electron, and AMEX cards.

We use Commidea to provide a secure server for processing credit/debit card transactions. Your card will be authorised at the time of order; and will only be charged when the order is despatched. Unfortunately we are unable to process orders for Retro Items over the telephone; they are available via the Lush & B Never Too Busy To Be Beautiful website only.

Should a buying period (Race) not successfully complete, no charge will be made to your card.

We will only accept credit or debit cards in the name of the customer. Please make sure that there are sufficient funds available on your card to cover the cost of the order, including the delivery costs. We will reserve the full value of your order against your debit or credit card at the checkout, but will only take payment for items when they are dispatched.

Customers must be aged 18 or over.

We reserve the right to cancel or suspend a customer’s involvement in Retro Sales, if this person, in our reasonable opinion, acts against these Terms and Conditions, including non-payment of ordered products or fraudulent use of the (Retro Sales section of the) Lush website. We have the right to bar certain customer accounts from accessing the (Retro Sales section of the) Lush website to place orders. We will not accept any Retro Sale order from any customer whose participation has been cancelled or suspended by us without our prior given consent. You agree to and accept this.

Delivery

All delivery times apply from the point at which the buying period (Race) for all Retro products you ordered in your transaction is closed.

* Packed weight includes the gross weight of products and all packaging materials.

** This service only applies if your area is not mentioned anywhere else.

*** Orders must be placed before 1:00pm (1300 BST) in order to be delivered the next working day (Monday – Thursday). If orders are placed before 1pm on Friday they will be delivered on Monday. If orders are placed between 1pm on Friday and 1pm the following Monday the parcel will be delivered on the Tuesday. Our Next Day service requires a signature upon receipt so you should provide us with delivery instructions or an alternative address if you think that no-one will be present at the delivery address to sign for the parcel.

Due to the made-to-order nature of our Retro products and associated production times, we are unable to offer the products for Next-Day delivery.

Delivery costs will be added to your order. The final total will include VAT calculated on your products and the cost of delivery. If you are placing your order from the UK or any other member state of the European Union (EU), your final total will include VAT at 17.5%. For orders placed outside the EU, VAT will be deducted from your total at the final stage of the checkout process.

We can ONLY deliver to the countries listed on the order form. If you require delivery elsewhere, please call us at +44 (0)1202 668 545.

Cancellation and Return

If the products that you receive are damaged or faulty or do not match the description given at the time of the sale of those products, you must return them to us within 14 working days of receiving them. In this case, you will be offered an exchange where possible, or a full refund after we receive the returned products. In case of damaged or faulty products or products that do not correspond to the description given at the time of sale we will pay for the postage costs.

Nothing in these Terms and Conditions affects your statutory rights as a consumer.

Your personal data, which you will have to submit when placing your order from our website, will be used for processing and invoicing your order only.

However, we would very much like to keep you up-to-date of all that is happening with Lush and our products. If you would be interested in this, you must use our opt-in system to subscribe for our newsletters and other direct marketing activities. When you tick the designated check box, we will send you an e-mail with a link. By clicking on the offered link, you confirm that we have the correct e-mail address and that that e-mail address is the same as the e-mail address given when ordering. This should prevent third parties subscribing others to our mailing list. Please note that newsletters and other direct marketing can be issued by us, Lush Limited, B Never To Busy To Be Beautiful or one of Lush’s subsidiaries (e.g. for posting your copies of Lush Times and the B catalogue).

Your data is not publicly available and will never be passed on to other third parties. Your data will be treated as strictly confidential.

If you do not wish to be approached by us anymore, Lush Limited, B Never To Busy To Be Beautiful or our subsidiaries for commercial purposes, then please send an e-mail to retro@lush.co.uk or contact us at +44 (0)1202 668 545 (but this does mean that you won’t get your Lush Times or B Catalogue anymore).

The cookies used on our Retro Lush website will only be temporary session cookies, which won't hold any customer information. Customer information will be stored in our back office system, which is separate from the website.

We pay a lot of care and attention to the contents of this website. Unfortunately, we all make mistakes sometimes and occasionally make omissions. We therefore cannot guarantee that the information on our website is completely free of errors. If you spot one please email retro@lush.co.uk and we’ll fix it as soon as possible.

We try our hardest to replicate the colours of the products we offer on this website. However, because different computers can display colours differently, the colours you see on screen might differ from the actual colours of the products.

Prices as stated on our website are in pounds sterling (£) and include VAT. You will be charged in pounds sterling, even if you reside outside the United Kingdom.

Please note that prices and promotions held in our high street stores may not apply to this website unless otherwise stated, and vice versa.

We, at our sole discretion, have the right to cancel or withdraw any Retro Sale at any given time. We will inform bidders of such cancellation as soon as possible. We shall not be liable for any orders already placed, nor for any damages. You understand and agree to this.

Law and Language

Any agreement between us and yourself will be governed by and construed according to English law. Both you and we commit to the non-exclusive jurisdiction of the English courts.

If any provision contained in these Terms and Conditions or any part thereof is declared or becomes unenforceable, invalid or illegal for any reason whatsoever, the other provisions shall remain in full force and effect as if these Terms and Conditions had been executed without the offending provision.

Any agreement will be communicated in English.

We reserve the right to alter these Terms and Conditions from time to time by posting new Terms and Conditions on this website.
